1. ACCEPTANCE ("website") is owned and operated by David Peterson and Digital Photo Secrets (a business of Vivitec Pty Ltd). Your access to, use of, and linking to the Website is conditional upon your acceptance and compliance with these terms and any other terms contained on the Site (Terms of Use). Your access to, use of, and linking to the Site constitutes your agreement to be bound by the Terms of Use. David Peterson reserves the right to amend the Terms of Use at anytime and you should periodically refer to them in this document.


The Website, the material on the Website, design, text, photos, images and graphics comprised in the Website, the names, logos and trade marks on the Website and the selection and layout of the Website (Content), if not stated otherwise, are owned or licensed by David Peterson and protected by copyright, trade mark and other intellectual property laws of Australia and other countries.


As part of the Photography Dash, you will upload your images to the Website. You retain full copyright over all your images. Your images will only be seen by other participants of the Photography Dash; David Peterson and his employees. You may not copy and use any images uploaded to the Website without prior permission by the original uploader, and David Peterson.

You may only upload images to the Photography Dash taken by you. You may not upload images taken by others, even if you have their permission.


You may view the Website and its Content using your web browser and save an electronic copy, or print out a copy, of the Website solely for your own information, research or study. You must not otherwise reproduce, transmit (including broadcast), adapt, distribute, sell, modify, frame, upload to a third party, post or otherwise use any of the Content except as permitted by written consent. You must not use the Website in any manner or for any purpose which is unlawful or in any manner which violates any rights of David Peterson or which is prohibited by the Terms of Use.


The Content is provided for information purposes only. In the construction of the Website, every effort has been made to provide the most up to date information possible. The Content was correct at the time of publication. However, David Peterson, Vivitec Pty Ltd, its employees, agents or representatives do not:

- give any representation or warranty as to the reliability, accuracy or completeness of the Content; or
- warrant that any of the functions contained in any Content or your access to the Site will be uninterrupted or error-free.
- David Peterson and its employees shall not be liable in any way for any loss or damage, howsoever arising (whether in negligence or otherwise) out of or in connection with the Content and/or any omissions from the Content.


You must indemnify and hold harmless David Peterson, Vivitec Pty Ltd, its employees, agents or representatives and keep them indemnified from and against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from:

- your access and/or use of the Site; or
- reliance upon or use of any Content by any person accessing any Content through your computer or website.


The website contains links to third party websites, but these linked websites are not under the control of David Peterson, and David Peterson is not responsible for the contents of any linked website or any hyperlink contained in a linked website. David Peterson Website provides these hyperlinks to you as convenience only, and the inclusion of any link does not imply any endorsement of the linked website by David Peterson. You link to any such website entirely at your own risk. Neither David Peterson nor its employees give any representation or warranty as to the reliability, accuracy or completeness of any information on other websites which are reached by hypertext links from the Website nor do they accept any responsibility arising in anyway (including negligence) for errors in, or omissions from, information contained on such other websites.


The Terms of Use are governed by, construed and enforced in accordance with the laws of Australia. Disputes arising from the Terms of Use are subject to the exclusive jurisdiction of the courts of Australia.


Commenting on the website is like having a conversation or speaking at a physical meeting, so normal social conventions apply. Help us to keep the conversation on topic by being polite, constructive and respectful of others. The use of inappropriate or offensive language is not permitted on the website. Inappropriate or offensive language includes, but is not limited to, any language or content that is sexually oriented, sexually suggestive, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, or contains racially, ethnically or otherwise objectionable material of any kind. Topics of discussion that are considered inappropriate on the website will be deleted without prior notification. If a thread does not fall into any category provided, it is regarded as inappropriate. We ask that you please be considerate to other members in the forum when posting your messages. Vivitec Pty Ltd reserves the right to ban a user at any time, without notice, if it is identified that users continue to post inappropriately. Vivitec Pty Ltd will not tolerate users expressing forms of bigotry, racism, hatred, or profanity. This includes, but is not limited to, the use of punctuation characters or symbols to simulate swearing. The website is designed to be accessed by people of all ages 16 and over, and foul language will not be tolerated. We encourage every user to treat every other user with mutual respect. Do not use the website to threaten, harass, stalk, or abuse others participating in any discussion. Vivitec Pty Ltd does not tolerate disruptive activity online, such as persistent off-colour comments and postings or statements that incite others to violate this user agreement or participate in illegal activities.
